General Terms

Eligibility

To use cybrixti services you must be legally able to enter into contracts and comply with applicable laws. Organizations and authorized representatives acting on behalf of a business may accept these terms.

Our services are intended for business professionals; individuals must meet the legal age requirements in their jurisdiction to enter binding agreements on behalf of a business entity.

You agree to use the services only for lawful business purposes and not to engage in activities that would violate export controls, intellectual property rights, privacy laws, or other applicable regulations.

Access to certain features may be limited based on jurisdictional restrictions or export control laws. Users are responsible for ensuring use complies with local laws in Thailand and any other jurisdictions involved.

Account and Registration

Certain cybrixti services require an account. When registering, provide accurate and current information and keep credentials confidential. You are responsible for all activity under your account.

Users must ensure personal and business information provided is true, complete, and updated. cybrixti may suspend or terminate accounts with inaccurate or fraudulent information.

Maintain strong passwords and protect access credentials. Notify cybrixti promptly at [email protected] if you suspect unauthorized account use.

Accounts, licenses, and access rights granted by cybrixti are non-transferable without prior written consent from cybrixti.

If you believe your account has been compromised, contact us immediately at [email protected]. We will contribute and take reasonable steps to secure affected accounts.

cybrixti may suspend or restrict account access if we suspect violations of these terms, abusive conduct, or security risks. We will notify affected users when feasible.

Services

cybrixti provides custom software development, integration, maintenance, and consultancy services to business clients. Service scope and deliverables are defined in project agreements or statements of work.

We may modify features, APIs, or service offerings. Substantial changes that affect contractual obligations will be reflected in updated agreements and communicated to clients.

cybrixti aims to maintain reliable service availability but does not promise uninterrupted access. Planned maintenance windows will be communicated in advance when practicable.

User Conduct Rules

Users must follow these rules when using cybrixti services. Violations may result in suspension or termination of access.

• Do not attempt unauthorized access to systems, accounts, or data.
• Do not interfere with service operations, such as by overloading networks or deploying malicious code.
• Respect intellectual property rights and do not upload or distribute unlicensed content.
• Do not use the service to distribute spam, malware, or other harmful content.
• Comply with export control laws and do not transfer restricted technology to prohibited jurisdictions.
• Provide truthful information in communications with cybrixti and related third parties.
• Use professional conduct in interactions with cybrixti personnel and other users.

User Content

User content includes data, code, documents, and other materials you provide to cybrixti or store within our services. You retain ownership of your content subject to these terms.

You represent that you have all rights necessary to provide user content and that its use by cybrixti for agreed services will not infringe third-party rights.

By submitting content you grant cybrixti a limited, non-exclusive license to use, reproduce, and modify the content solely to provide and improve contracted services, perform maintenance, and meet legal obligations.

You are responsible for maintaining backups of your content and ensuring it does not contain sensitive personal data without appropriate lawful basis and protections.

cybrixti may remove content that violates these terms or applicable law. We will notify you prior to removal when feasible, except where immediate action is required for security or legal reasons.

Intellectual Property

All cybrixti activity, service marks, branding, and pre-existing software remain the property of cybrixti. Custom software developed under a separate agreement will have ownership terms defined in that agreement.

• Do not copy, modify, or distribute cybrixti proprietary code without authorization.
• Do not remove or alter intellectual property notices in cybrixti materials.
• Respect third-party license terms for libraries and tools used in development projects.

Paid Services

Certain services, custom projects, and support packages provided by cybrixti require payment. Terms for paid services are set out in quotes, invoices, and project agreements.

Pricing is based on project scope, resource allocation, and agreed deliverables. Estimates are provided in writing and subject to change if scope or requirements are revised.

Payments are due according to invoicing terms stated in the applicable agreement. Accepted payment methods will be specified in invoices and may include bank transfer or electronic payment.

Subscription services, if offered, will be billed according to the selected plan and billing cycle. Cancellation terms and any prorated adjustments are described in the subscription agreement.

Refunds are considered on a case-by-case basis per the terms of the project agreement. Where work has been performed and accepted, refunds may be limited or not available.

Either party may terminate a project as specified in the project agreement. Termination may trigger final invoicing for work performed and reasonable wind-down costs.

Clients are responsible for applicable taxes related to services. cybrixti will invoice taxes when required by law and provide tax documentation as needed.

Price adjustments for ongoing services will be communicated in writing with reasonable notice and will not retroactively affect amounts already invoiced.

Non-payment may result in suspension of services, withholding of deliverables, or termination of agreements after notice and an opportunity to remedy the default.

Disclaimer

Information and services are provided on an as-is basis. cybrixti does not provide professional advice tailored to every situation unless explicitly contracted to do so. Clients are expected to evaluate the suitability of delivered solutions for their business needs.

Limitation of Liability

To the extent permitted by law, cybrixti's liability for any direct damages arising from services is limited to amounts paid for the relevant services during the 12 months prior to the claim. cybrixti is not liable for indirect, special, or consequential damages such as lost benefits or lost business opportunities.

Third-Party Services

Services may integrate third-party tools, cloud providers, or libraries. Use of third-party components is subject to the third party's terms and privacy policies. cybrixti is not responsible for third-party services beyond integration and agreed support.

Termination

Either party may terminate services as provided in the applicable agreement. Termination may occur for breach, insolvency, or by mutual agreement with provisions for final settlement.

Upon termination, access to services will cease, outstanding fees become due, and either party may retain copies of work subject to confidentiality and license provisions. Data retention and handover procedures will follow the project agreement.

Privacy

cybrixti processes personal data in accordance with our Privacy Policy. Personal data collected to provide services will be used only for legitimate business purposes as described in that policy.

Communications

Official communications related to service delivery, invoices, and legal notices will be sent to the contact details provided in your account or project agreement. Electronic messages are considered effective communication.

Changes to Terms

cybrixti may update these Terms of Service to reflect legal, operational, or business changes. Material revisions will be posted on cybrixti.click with an effective date. Continued use after changes indicates acceptance.

Governing Law

These terms are governed by the laws applicable in Thailand. Disputes arising under these terms will be subject to the jurisdiction of Thai courts unless otherwise agreed in a specific contract.

Dispute Resolution

Before initiating formal legal proceedings, parties should attempt to resolve disputes through good-faith negotiations. If unresolved, disputes will proceed as specified in the applicable agreement or under the governing law stated above.
